1. ACCEPTANCE OF TERMS
By downloading, accessing, registering on, or using The Church App (“the App”), you (“User”, “Church”, “Congregant”, “you”) agree to be bound by these Terms and Conditions (“T&Cs”). If you do not agree, do not download or use the App.
These T&Cs apply to:
Churches (Institutional Subscribers/Administrators)
Individual Users (Members, Visitors, Prayer Intercessors, etc.)
2. DEFINITIONS
“ABC Digital” – ABC Digital (Pty) Ltd, the developer and owner of The Church App.
“The Church App” – The mobile application, backend dashboards, and associated services.
“Phygital Ministry” – The integration of physical church gatherings with digital tools as described in our materials.
“Church Subscriber” – A Church entity that enters into a subscription agreement with ABC Digital.
“End User” – Any Individual who downloads the App or registers as a member of a Church Subscriber.
3. LICENSE TO USE
ABC Digital grants you a non-exclusive, non-transferable, revocable license to use The Church App for personal, faith-based, and ministry-related purposes, subject to these T&Cs.
Churches: May use the App for internal ministry operations, member engagement, giving collection, event management, and content distribution.
Individual Users: May use the App to engage with their church, access sermons, submit prayer requests, give tithes/offerings, and interact with church members.
All rights not expressly granted are reserved by ABC Digital.
4. PROTECTION OF ABC DIGITAL AND THE CHURCH APP (INDEMNITY & LIABILITY)
4.1 No Warranties
The App is provided “as is” and “as available”. ABC Digital makes no representations or warranties of any kind, express or implied, regarding the App’s operation, availability, accuracy, or suitability for any particular purpose.
4.2 Limitation of Liability
To the fullest extent permitted by South African law (including the Consumer Protection Act 68 of 2008, where applicable), ABC Digital shall not be liable for any:
Direct, indirect, incidental, special, or consequential damages;
Loss of data, revenue, or ministry opportunities;
Unauthorized access to church or member data;
Downtime, technical errors, or third-party service interruptions.
4.3 Indemnification
You agree to indemnify, defend, and hold harmless ABC Digital, its directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of:
Your misuse of the App;
Your violation of these T&Cs;
Any content you post (e.g., prayer requests, business directory listings);
Any dispute between you and another user or church.
4.4 No Responsibility for Church Content
ABC Digital does not endorse, monitor, or assume responsibility for any sermons, prayer requests, announcements, or directory listings posted by Churches or Users. The Church Subscriber remains solely responsible for its content.
5. USER ACCOUNTS AND REGISTRATION
You must provide accurate, current, and complete information during registration.
You are responsible for safeguarding your login credentials.
Churches must designate authorized administrators and ensure role-based access is properly managed.
ABC Digital reserves the right to suspend or terminate any account that violates these T&Cs.
6. FINANCIAL TRANSACTIONS (TITHES & OFFERINGS)
The App enables secure in-app giving. All transactions are processed through PCI-compliant third-party payment gateways. The costs to process these transactions and deposits are back-to-back costs direct from the processing Payment Gateway and are passed on to the Church Subscriber. ABC Digital does not charge additional fees for this service.
Payments for Giving and Donations are processed every Friday. It is the responsibility of the Church and their representative managing their Church Profile to ensure all banking information is completed and correct at the time of processing payments. Failure to complete and comply will result in delayed payouts. ABC Digital accepts no responsibility for this.
ABC Digital is not a financial institution and does not handle funds directly; we facilitate the connection between Givers and the Church (Subscriber).
Transaction fees (if any) will be disclosed to the Church (Subscriber) separately.
Refunds are at the sole discretion of the Church (Subscriber), not ABC Digital.
7. PRAYER WALL & USER CONTENT
The Prayer Wall allows public and anonymous posting of prayer requests.
Do not post personally identifiable information (PII) or confidential data.
ABC Digital reserves the right (but not the obligation) to remove prayer requests that contain offensive, illegal, or harmful content.
You grant ABC Digital a worldwide, royalty-free license to host, store, and display your content as necessary to operate the App.
8. BUSINESS DIRECTORY
Churches and Members may list businesses for mutual support.
ABC Digital does not verify, endorse, or guarantee any listed business. Through certain programming protocols, the app would promote ethical working practices based on godly principles at all times.
Users transact at their own risk. ABC Digital and The Church App is not liable for any disputes or losses arising from directory-based interactions.
9. DATA PRIVACY AND POPIA COMPLIANCE
ABC Digital processes personal information in accordance with:
South Africa’s Protection of Personal Information Act (POPIA);
Our separate Privacy Policy (available in-app and on our website).
Churches (Subscribers) are independent responsible parties under POPIA for their member data. ABC Digital is a processor acting on instructions from the Church. Each Church must ensure it has lawful grounds to share member information with ABC Digital.
Individual Users consent to their data being used for ministry engagement, analytics, and personalized content as described in our feature set. ABC Digital uses this data for hyper-personalisation, heat maps, etc.).
10. ACCEPTABLE USE POLICY
You may NOT use The Church App to:
Post hate speech, harassment, or discriminatory content;
Engage in illegal activities;
Distribute malware or attempt to hack the App;
Send SPAM or unauthorized commercial messages;
Violate any South African laws or religious community standards.
Violation will result in immediate suspension and reporting to authorities.
11. INTELLECTUAL PROPERTY
All trademarks, logos, code, design, and content of The Church App (excluding user-generated content and church sermons) are owned by ABC Digital (Pty) Ltd. You may not copy, reverse-engineer, modify, or create derivative works without written permission.
Church Subscribers retain ownership of their sermons and member data. ABC Digital retains ownership of the App platform and aggregated anonymized data.
12. THIRD-PARTY SERVICES
The App may integrate with Bible APIs, payment gateways, push notification services, or analytics tools. ABC Digital is not responsible for the uptime, security, or practices of third parties.
13. TERMINATION
By User: You may delete your account at any time via App settings.
By Church (Subscriber): A Church may cancel its subscription as per its separate agreement. No refunds will be settled to the Church in lieu of subscription fees paid for that month during cancellation. If a Church paid upfront for Annual Subscription, then the remaining months; subscription fees will be refunded.
By ABC Digital: We may suspend or terminate access immediately if you breach these T&Cs or pose a risk to the App or other users.
Upon termination, ABC Digital will delete or return Church data as required by law and the subscription agreement.
14. AMENDMENTS TO THESE T&Cs
ABC Digital may update these T&Cs from time to time. Material changes will be notified via the App or email. Continued use after notice constitutes acceptance.
15. GOVERNING LAW & DISPUTE RESOLUTION
These T&Cs are governed by the laws of the Republic of South Africa.
Any dispute arising from these T&Cs or the use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be referred to binding arbitration in terms of the Arbitration Foundation of Southern Africa (AFSA) Rules, held in Durban (or as ABC Digital elects), with costs borne by the unsuccessful party.
